“Crimes against humanity” does not mean “crimes against homo sapiens” or “crimes committed by human beings against human beings”, it means “crimes committed against basic decency that violate the rights of personhood”.
It is referring to the philosophical concept of humanity, i.e. *being humane*, i.e. acts, not referring to the species.
Because the first thing you do in any genocide is label the other as not human.
